New article on mediation published in Harvard's law journal

Harvard Law School's Journal of Sports & Entertainment Law has published Mark Grabowski's article on why pro sports should utilize mediation. The Business of Sports blog wrote about it.

The 26-page article, "Both Sides Win: Why Mediation Would Improve Pro Sports," argues that mediation should be utilized by American pro sports leagues to resolve conflicts, particularly contract disputes.
Citing examples and experts, the paper argues that it would improve player-management relationships, player morale and public opinion.

"At the moment, this method of alternative dispute resolution is seldom used in pro sports," Grabowski said. "But given the unique nature of sports disputes along with a mediator’s success in ending the 2012-13 National Hockey League labor strike, it should be utilized much more often, instead of management and athletes relying on the commonly used resolution methods of arbitration, litigation and protracted negotiations."

Grabowski is an assistant professor of communication at Adelphi University in Long Island. He previously worked as a lawyer and a sports journalist. He frequently publishes original research on sports communication and law & ethics, including a book chapter on the media's coverage of Tiger Wood's sex scandal and a forthcoming book chapter on fantasy sports law.

Mark Grabowski published an op-ed in the USA Today on Nov. 12, 2014, in response to President Obama's proposal for new Internet regulations.

Grabowski supports Obama's proposal to regulate the Internet as a public utility. The lessons learned from U.S. history along with contemporary international examples illustrate the benefits of such regulation, argues Grabowski, a lawyer who teaches Internet Law at Adelphi University. He previously published a book chapter that examines this issue in depth.

The USA Today is the 2nd-largest newspaper in the U.S., with a daily circulation of 1.8 million, a daily readership of 3.1 million and 34 million unique website visitors a month.
